Terms of Service

These terms govern the use of the CercaPros website (the “Platform”). By registering on the Platform, you confirm that you have read and accept the terms below. How we handle your personal data is described separately in the Privacy Policy, and cookie use in the Cookie Policy. These terms are published in Spanish, Russian and English; if the versions differ, the Spanish version prevails.

1. What the Platform is

The Platform is a service that helps clients (“Clients”) find service providers (“Specialists”) and vice versa. The Platform is not a party to the service agreement between a Client and a Specialist, does not provide services itself, and does not control their quality, timing, or outcome.

All agreements about price, timing, scope, and quality of work are arranged directly between the Client and the Specialist. The Platform is not the Specialists' employer and has no employment relationship with them.

2. Registration and account

The Platform may only be used by people 18 or older. By registering, you confirm that you are at least 18.

Using most of the Platform's features requires registering with accurate information (name, email and/or phone number).

You are responsible for keeping your account login details secure and for all actions taken under your account.

A Specialist may voluntarily upload an identity document to earn the “Identity verified” badge. The document is used solely for review by the Platform's administrator, is not published, and is not shared with third parties other than the provider that hosts the database (Prisma Data Platform). The badge means only that the administrator compared the document with the profile's details; it is not a background check and does not guarantee the safety or quality of the service.

3. User rights and obligations

It is prohibited to provide knowingly false information about yourself or your services, to post offensive, unlawful, or misleading content, or to offer or seek sexual services on the Platform.

Don't write an email address, links or social media handles in your profile, your name, a request or a review: they are not published there. A client sees a specialist's number with the “Show number” button if the specialist turned on “Show my number and WhatsApp”; a specialist sees the client's number in the conversation once the client replies or chooses them. Next to the number there is a WhatsApp button.

Photos of your work: don't show a recognizable person or the inside of a home without the consent of that person or of the home's owner; don't post photos of children; don't show house numbers, addresses or anything else that would let someone find a home.

What you publish remains yours. You give the Platform a free, non-exclusive license to show it on the Platform and in the link previews and profile images the Platform makes, for as long as it is published. If we show your content on CercaPros's social media, we use a photo in which a person can be recognized only with that person's consent.

If you offer an activity that by law requires a degree, a license or a registration (for example, electrical work, legal advice, massage, psychology or accounting), you declare that you have it. You can give your license or registration number on your profile; the Platform does not verify it.

Each Specialist is responsible for the prices they give being true. A price “from” is the real lowest price for which they do that work.

A Specialist may not rate a client in retaliation for the client having filed a complaint or left a review.

If there are signs of sexual or labor exploitation of people, especially of children or adolescents, we keep the information and report it to the Public Prosecutor's Office (Ministerio Público) or the National Police (Policía Nacional).

The content you publish — profile data and keywords, requests, reviews, photos and the video cover — goes through an automated review: the Platform's own list of banned words and an artificial-intelligence service (see the Privacy Policy, Section 5). A text the review finds unacceptable is refused right away: you can correct it and send it again. If you think this is a mistake, you can ask for a person to review the decision by writing to info@cercapros.com; we reply within 5 business days. A name is refused right away only by the Platform's own list of banned words; a doubtful name is published and sent to the administrator for review. A doubtful profile description, license or registration, request, review or reply is also published and sent to the administrator for review. A keyword or a line of “Services and prices” the review is not sure about, like such an uploaded photo, is looked at by the administrator before it is published. The administrator may remove content already published; a keyword rejected by the administrator becomes unavailable to all users.

Chat messages are not reviewed automatically. The administrator may read the conversation between two users only while handling a report connected with it: the report's card shows the last messages between them, and every opening of the whole conversation is recorded. Also, if you ask for a copy of your data, the file includes the messages you sent; if your account has no confirmed email, the administrator downloads it to hand it to you, and this is recorded.

By using the chat you accept that, if a report connected with a conversation is filed, the administrator may read that conversation only to resolve that report. Every opening of the whole conversation is recorded.

If content on the Platform infringes your rights — copyright, your image or privacy, your honor or reputation — report it with the “Report content that infringes rights” form on the “Who runs CercaPros” page (linked at the bottom of every page). You don't need to log in. That page also names the representative for complaints about infringements of third-party rights (Article 19 of Law No. 4868/2013) and their contact details.

For a violation of these terms, the administrator may: warn the user; remove an unacceptable text from a name or a profile; hide a Specialist's profile or a request, including until it is corrected; delete a review or a reply to a review; cancel a request; delete a Specialist's profile or the whole account; block the account. The administrator may also reset an account's phone number — for example, when the number has changed hands.

The administrator blocks an account, or deletes it without your asking, only for a violation of these terms or when a competent authority requires it. We write the reason to the account's confirmed email, if it has one; a block is also announced under “Notifications”. If you think this is a mistake, write to us at info@cercapros.com within 30 days: a person will review the decision.

4. Liability

The Platform is not a party to the agreements between Clients and Specialists (see Section 1). Each Specialist is responsible for the services they provide.

We are responsible for our own acts and omissions in running the Platform, without prejudice to any liability the law does not allow to be excluded. We make reasonable efforts to keep the site running reliably; there may be interruptions for maintenance or technical failures.

5. Changes to these terms

We may update these terms. For substantial changes we give at least 15 days' notice under “Notifications” and, if your active account has a confirmed email, by email too. When they take effect, we ask you to accept the new version. If you don't accept it, you can close your account: deactivate it in “Account settings” or ask us to delete it. Changes that do not affect your rights are published with the new date at the top of the document.

6. Governing law and courts

These terms are governed by the laws of the Republic of Paraguay, including Law No. 4868/2013 on Electronic Commerce, Decree No. 1165/2014 that regulates it, and Law No. 1334/1998 on Consumer Protection. If you are a consumer, disputes are submitted to the competent courts of your domicile. In other cases, they are submitted to the courts of the city of Asunción, Republic of Paraguay.

7. Complaints

If you have a complaint about the Platform, write to us first at info@cercapros.com. If it is not resolved, you can turn to:

  • the Ministry of Industry and Commerce, Directorate General of Digital Signature and Electronic Commerce (Ministerio de Industria y Comercio — Dirección General de Firma Digital y Comercio Electrónico): https://www.mic.gov.py
  • if you are a consumer, the Secretariat for Consumer and User Protection (Secretaría de Defensa del Consumidor y el Usuario, SEDECO)

8. Stores

The “Stores” section shows pages of hardware and building-supply stores (the “Stores”). The Platform does not sell products, take orders or payments, or deliver: you agree on and make the purchase directly with the Store, at its premises or as it indicates. The Platform is not a party to that purchase and does not act on the Store's behalf.

A Store's products, prices, promotions, opening hours, photos, payment methods and contact details are provided by the Store itself, which is responsible for them being true. The Platform does not set or control Stores' prices or stock. The date next to a price (“price as of…”) is the day the Store provided or confirmed it; a price the Store does not confirm for 30 days stops being shown. Before you go, check the price and stock with the Store. This does not limit the rights the law gives you against the Store.

A promotion is shown until the day the Store sets, and its terms are the Store's; if the page does not list them, ask the Store. Raffles and prize draws are not published.

Some Stores give a discount to Specialists with a published profile on the Platform, who ask for it by showing their “Specialist card” at the checkout. The discount is given and paid for by the Store itself: it sets the amount and the terms and may change or withdraw them; the Store's page shows what currently applies. The Platform charges and receives nothing for this discount. The card is personal.

A Store's page is managed by an account the Store authorized and the Platform invited. Whoever manages it confirms that they may act for the Store and that the Store: publishes final prices in guaraníes, taxes included; honors each promotion until the stated day and, if it must end it early, removes it from the page; has the right to use the photos, logos and texts it uploads — its own photos or with their author's permission —, uses third-party trademarks only to name genuine products it sells, and its photos show the real product; does not publish photos in which a person can be recognized without their consent, or photos of children. The license in Section 3 applies to what the Store publishes.

A Store's texts and photos go through the same review as other content (Section 3). The administrator may refuse or remove a product, a promotion, a photo or the description, and hide a Store's page, if these terms are breached, the information proves false, there is a well-founded complaint, or a competent authority requires it. We tell whoever manages the Store the reason, unless urgency prevents it; if they think it is a mistake, they can write to us and a person will review the decision. Anyone with an account can report a Store with the “Report” button; content that infringes copyright or a trademark can also be reported with the form on the “Who runs CercaPros” page.

Having a Store page on the Platform is free today. If the Platform starts charging for the page or for extra features, it will tell whoever manages the Store by email at least 30 days in advance, with the price and the terms. Nothing is charged unless the Store expressly accepts; if it does not, it can ask for its page to be removed at no cost. Special terms agreed in writing with a Store are honored as agreed.

The “CercaPros partner” label means the Store has an arrangement with the Platform, such as the Specialist discount. It does not make the Platform a partner, agent or guarantor of the Store or its products.

Whoever manages a Store sees in their dashboard how many times a day the page was opened and its buttons tapped. These are numbers only: the Store does not receive the name, number or any other data of the people who viewed the page.
